Agreement to Terms
By accessing and using My Chef ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
Description of Service
My Chef provides a comprehensive restaurant management platform including:
- QR code-based digital menu and ordering system
- Real-time kitchen dashboard and order management
- Online payment processing through Stripe
- Table management and session tracking
- Reporting and analytics tools
- Menu customization and item management
Account Registration
To use My Chef, you must:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Be at least 18 years old or of legal age in your jurisdiction
- Represent a legitimate restaurant or food service business
- Notify us immediately of any unauthorized account access
You are responsible for all activities that occur under your account.
Pricing and Payment
Free Platform Access
My Chef is free to use with no monthly subscription fees. You only pay per successful order.
Transaction Fees
- 2.9% + $0.30 per online transaction (Stripe processing fees)
- Fees are automatically deducted from each payment
- Prices subject to change with 30 days notice
Payment Processing
All payments are processed through Stripe. You must comply with Stripe's terms of service and maintain a valid payment method.
Acceptable Use
You agree not to:
- Use the Platform for any illegal or unauthorized purpose
- Violate any laws or regulations in your jurisdiction
- Infringe on intellectual property rights
- Transmit viruses, malware, or harmful code
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Platform's operation
- Use automated tools to scrape or harvest data
- Impersonate another person or entity
- Upload offensive, defamatory, or inappropriate content
Restaurant Responsibilities
As a restaurant using My Chef, you are responsible for:
- Ensuring menu accuracy, pricing, and availability
- Complying with food safety and health regulations
- Fulfilling orders in a timely and professional manner
- Maintaining appropriate business licenses and permits
- Handling customer disputes and refunds appropriately
- Collecting and remitting applicable taxes
Intellectual Property
Our Rights
My Chef and its original content, features, and functionality are owned by us and protected by copyright, trademark, and other intellectual property laws.
Your Content
You retain ownership of content you upload (menus, images, descriptions). By uploading content, you grant us a license to use, display, and distribute it as necessary to provide our services.
Service Availability
While we strive for 99.9% uptime, we do not guarantee uninterrupted access. We may:
- Perform scheduled maintenance with advance notice
- Make emergency updates or repairs
- Temporarily suspend service for technical issues
- Modify or discontinue features with notice
Limitation of Liability
To the maximum extent permitted by law:
- My Chef is provided "as is" without warranties of any kind
- We are not liable for indirect, incidental, or consequential damages
- Our total liability is limited to fees paid in the 12 months prior to the claim
- We are not responsible for third-party services (Stripe, payment processors)
- You assume all risks of using the Platform
Indemnification
You agree to indemnify and hold My Chef harmless from any claims, damages, or expenses arising from:
- Your use of the Platform
- Your violation of these Terms
- Your violation of any third-party rights
- Content you upload or provide
- Your restaurant operations
Termination
We may terminate or suspend your account immediately if you:
- Violate these Terms of Service
- Engage in fraudulent activity
- Cause harm to our Platform or users
- Fail to pay required fees
You may cancel your account at any time through your account settings.
Dispute Resolution
Governing Law
These Terms are governed by the laws of the jurisdiction where our company is registered.
Arbitration
Any disputes will be resolved through binding arbitration rather than court proceedings, except where prohibited by law.
Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be notified via email or platform notification. Continued use after changes constitutes acceptance.
